Terms of Service

These Terms set the rules for using ListenViral. They are designed to protect creators, the Service, and the public platforms that make trend research possible.

1. Agreement and eligibility

By accessing or using the ListenViral website, web application, tracking agents, reports, alerts, and related services (together, the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into a contract. If you use ListenViral for a company, agency, or client, you confirm that you have authority to accept these Terms on their behalf. In that case, “you” includes that business or client.

2. Accounts

You must provide accurate information and keep it current. You are responsible for protecting your password and sign-in method, for the activity of people you authorize, and for promptly telling us about suspected unauthorized access.

You control the agents and content created through your account. Do not share an account between people. You are responsible for every action taken through your account.

3. The Service

ListenViral helps users monitor public short-form content and public creator accounts, identify unusual momentum, organize saved ideas, and receive analysis or reports. Results depend on your instructions, public information, provider availability, and statistical or automated analysis.

We may add, change, or retire features to improve the Service, address security or legal requirements, or respond to changes made by supported platforms. We will provide reasonable notice when a material change significantly reduces a paid feature, unless urgent security, legal, or third-party issues make advance notice impractical.

Beta, preview, and early-access features may be incomplete, change without notice, or be discontinued. They are provided for testing and feedback and should not be relied on for critical decisions.

4. Your instructions and content

You retain ownership of the niches, keywords, public handles, notes, prompts, feedback, and other material you submit to the Service (“User Content”). You give ListenViral a worldwide, non-exclusive license to host, copy, process, transmit, and display User Content only as needed to operate, secure, support, and improve the Service.

You confirm that you have the rights and permissions needed to submit User Content and configure each tracking or delivery destination. Do not submit confidential information, private account credentials, sensitive personal information, or material that you are not permitted to use.

5. Acceptable use

You may not use the Service to:

  • break the law or facilitate unlawful conduct;
  • infringe intellectual property, privacy, publicity, or other rights;
  • harass, stalk, threaten, discriminate against, or build sensitive profiles about a person;
  • monitor private accounts or bypass platform access controls, blocks, authentication, or technical restrictions;
  • upload malware, disrupt the Service, probe for vulnerabilities, or access systems or data without permission;
  • circumvent quotas, rate limits, plan restrictions, or account controls;
  • use automated means to copy or extract the Service itself without our written permission;
  • reverse engineer the Service except to the limited extent that applicable law does not allow this restriction;
  • resell, sublicense, or provide the Service as a standalone product unless your plan or a written agreement permits it; or
  • misrepresent the source, ownership, performance, or endorsement of content you create using research from ListenViral.

We may investigate suspected misuse and take proportionate action, including limiting a feature, removing unlawful material, or suspending access.

6. Third-party platforms and content

The Service works with public information and links from services such as TikTok and YouTube. Those services are not owned or controlled by ListenViral. Their terms, developer rules, content availability, and privacy practices apply independently and may change without notice.

Public posts, music, video, images, scripts, trademarks, and creator identities remain the property of their respective owners. A result appearing in ListenViral does not give you permission to copy, download, republish, or commercially exploit it. You are responsible for obtaining any permission, license, or attribution your use requires.

We may remove a source, link, or integration when necessary to comply with law, a rights request, or platform requirements. We are not responsible for third-party content or for changes, outages, or restrictions imposed by another service.

7. AI-assisted and analytical features

Some features use statistical models or third-party AI services to suggest search terms, score public signals, summarize why content may be working, transcribe audio, or propose a creative direction. These outputs can be incomplete, inaccurate, similar to other outputs, or unsuitable for your audience.

You must review outputs before using them. Verify facts, clear the rights to any material you publish, and apply your own judgment. ListenViral does not promise that a trend will continue, that a suggested video will perform, or that an output is unique or free of third-party rights.

8. ListenViral intellectual property

ListenViral and its licensors own the Service, including its software, design, branding, documentation, and original content. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable right to use the Service during your account term for your own creator or internal business purposes.

If you send feedback or suggestions, you allow us to use them without restriction or payment. This does not give us ownership of your User Content or confidential material.

9. Plans, billing, and cancellation

Plan features and limits are described at sign-up, in the Service, or at checkout. Free access may be subject to usage limits and does not guarantee that every feature will remain free.

If you purchase a paid subscription, the checkout page will show the price, currency, billing interval, taxes when applicable, renewal terms, and how to cancel before you agree to pay. Unless the offer says otherwise, paid subscriptions renew automatically for the same interval until canceled. You authorize the payment provider to charge the payment method on file for each renewal.

You may cancel a paid subscription through the account or billing controls made available to you, or by contacting us. Cancellation stops future renewals and normally takes effect at the end of the current paid period. Except where applicable law requires otherwise or a written offer states otherwise, charges for a period that has begun are not refundable. Your access continues through the paid period unless the account is terminated for serious misuse.

We may change a future subscription price with advance notice. The new price applies no earlier than your next renewal after the notice period. You can cancel before that renewal if you do not accept the change.

10. Suspension and termination

You may stop using ListenViral at any time. To request account closure, contact us from the email associated with your account.

We may suspend or terminate access if you materially breach these Terms, create a security or legal risk, fail to pay an amount due, or use the Service in a way that could harm other users, third parties, or ListenViral. Where reasonable, we will explain the issue and give you an opportunity to correct it. Immediate action may be necessary for fraud, abuse, security incidents, legal requirements, or serious repeated violations.

Terms that by their nature should survive will remain in effect, including ownership, payment obligations, disclaimers, liability limits, dispute terms, and rights needed to complete deletion or maintain lawful records.

11. Copyright and rights concerns

If you believe content or a link available through ListenViral infringes your rights, email passivecraftcontact@gmail.com. Include your contact information, the material or right at issue, the relevant ListenViral or source URL, the action you request, and a statement explaining why you are authorized to make the report.

We may ask for more information, forward the notice to the affected user where appropriate, and remove or restrict material while we review a valid request. Knowingly false reports may create legal liability.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” ListenViral disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not guarantee uninterrupted availability, complete platform coverage, the accuracy or freshness of public metrics, a particular number of results, continued access to a third-party integration, or any audience, revenue, or performance outcome. Nothing in the Service is legal, financial, or professional advice.

Some jurisdictions do not allow certain warranty exclusions. In those places, the exclusions apply only to the extent permitted by law.

13. Limitation of liability

To the fullest extent permitted by law, ListenViral and its owners, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunity, or anticipated savings arising from or related to the Service.

To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of the amount you paid to ListenViral for the Service during the 12 months before the event giving rise to the claim or USD 100.

These limits do not apply to liability that cannot legally be limited, including fraud, willful misconduct, or rights and remedies that mandatory consumer law protects.

14. Indemnity

If you use the Service for business purposes, you will defend and indemnify ListenViral and its owners, personnel, and affiliates from third-party claims, damages, and reasonable costs arising from your User Content, your published content, your violation of these Terms, or your infringement of another person’s rights. This duty does not apply to the extent a claim was caused by ListenViral’s own unlawful conduct.

15. Governing law and disputes

These Terms are governed by the laws of Morocco, without regard to conflict-of-law rules. Before filing a formal claim, you and ListenViral agree to make a good-faith effort for 30 days to resolve the issue by email. Send a dispute notice to passivecraftcontact@gmail.com with a description of the issue and the resolution requested.

If the issue is not resolved, the courts with jurisdiction in Morocco will have jurisdiction over the dispute. If you are a consumer, this section does not remove any mandatory protection or right to bring a claim in another court that applicable consumer law gives you.

16. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security practices, or our business. We will post the revised Terms and update the date at the top. For material changes, we will provide reasonable additional notice when required. Continuing to use the Service after the effective date means you accept the revised Terms. If you do not agree, you must stop using the Service and cancel any renewal before it occurs.
